Terms of Service

These Terms of Service, referred to as the “Terms,” govern your access to and use of websites, communications, games, events, promotions, content, and services operated or provided by Drinquilibrium, Brain Brew Games, and their respective affiliated businesses, subsidiaries, brands, divisions, licensed operations, and related entities, collectively referred to as “Brain Brew,” “we,” “us,” or “our.”

These Terms apply to brainbrewgames.com, brainbrew.games, and any related pages, landing pages, forms, QR-code destinations, text programs, email programs, chat tools, promotional programs, standings pages, event listings, registrations, games, tournaments, private events, sponsor activities, venue activities, and other Brain Brew services that reference these Terms.

By accessing our websites, submitting information to us, participating in Brain Brew games or events, registering for a promotion, communicating with us, joining a messaging program, or otherwise using our services, you agree to these Terms and our Privacy Policy.

1. Brain Brew Services

Brain Brew provides entertainment, games, events, promotional experiences, venue programming, tournaments, private-event services, sponsor opportunities, communications, online content, and related services.

Brain Brew products and programs may include, without limitation:

  • Trivia games;

  • Musical Squares and music-based games;

  • Brew-Teria and similar card, cultural, or chance-based entertainment formats;

  • Pigskin Squares and sports-related games;

  • Tournaments, championships, leagues, qualifying events, standings, and rankings;

  • Private events, corporate events, community events, and promotional events;

  • Loyalty programs, rewards, clues, contests, giveaways, prizes, sponsor perks, and audience engagement programs;

  • Venue entertainment, sponsor placements, advertising opportunities, promotional communications, and business partnerships; and

  • Future games, products, events, programs, websites, communications, and services offered under a Brain Brew-related brand.

We may add, remove, revise, suspend, replace, cancel, or modify services, events, games, rules, schedules, locations, hosts, prizes, features, promotions, standings methods, or eligibility requirements at any time.

2. Eligibility and Venue Rules

Our websites may be accessed by the general public. Participation in individual events, venues, promotions, or games may be limited by applicable law, venue policy, alcohol-service rules, age restrictions, event rules, prize eligibility requirements, or other conditions.

Brain Brew events may occur at bars, restaurants, breweries, entertainment venues, event spaces, private locations, sponsor locations, or other third-party venues. Each venue is independently responsible for its own:

  • Admission and age policies;

  • Alcohol sales and service;

  • Food and beverage products;

  • Reservations and seating;

  • Staff conduct and customer service;

  • Security, safety, accessibility, and premises conditions;

  • Refund, tab, purchase, parking, and house policies; and

  • Compliance with laws applicable to the venue.

Participation in Brain Brew programming does not guarantee admission, seating, service, food or beverage availability, or eligibility to remain at a venue.

You agree to comply with venue rules, instructions from hosts or staff, applicable laws, and reasonable standards of conduct while attending or participating in a Brain Brew activity.

3. Free-to-Play Games; No Purchase Required

Unless separately and clearly stated for a specific private event, ticketed event, merchandise purchase, or other distinct offering, regular Brain Brew public games are intended to be free to play, and no purchase is required to participate or win a regular game prize.

A venue may sell food, beverages, or other products during a Brain Brew event, but a purchase is not required by Brain Brew to participate in a free-to-play public game.

Certain tournaments, special promotions, ticketed events, charitable programs, private events, or future offerings may be governed by additional terms, official rules, eligibility requirements, entry procedures, or charges disclosed separately.

 
4. Games, Scores, Standings, Tournaments, and Prizes

Brain Brew may establish game rules, scoring rules, tie-breakers, qualification methods, tournament rules, standings systems, prize structures, scheduling requirements, eligibility standards, and promotional conditions.

You acknowledge and agree that:

  • Game formats, questions, categories, clues, scoring, answers, tie-breakers, standings, tournament structures, eligibility, prizes, hosts, venues, schedules, and rules may change;

  • Scores and standings may be based on team names, venues, attendance, team participation, player information, host records, electronic records, or reasonable administrative determinations;

  • Brain Brew may correct scoring, standings, clerical, technical, data-entry, duplication, spelling, reporting, or eligibility errors;

  • Brain Brew may consolidate, correct, reject, or modify team names where names are duplicated, inconsistent, offensive, misleading, or reasonably believed to refer to the same team;

  • Brain Brew may publish team names, scores, standings, rankings, qualification status, results, winner information, and event-related announcements;

  • Prizes may be supplied by Brain Brew, a venue, a sponsor, a promotional partner, or another third party;

  • Prizes are subject to availability and may be substituted, modified, withdrawn, or subject to additional restrictions;

  • Participants are responsible for any tax obligations associated with prizes; and

  • Separate tournaments, contests, sweepstakes, promotions, or special events may include additional official rules that control in the event of a conflict with these general Terms.

All Brain Brew and host decisions concerning routine game administration, scoring, player conduct, eligibility, standings, qualification, and prize administration are final to the extent permitted by law.

5. Conduct and Disqualification

Brain Brew is intended to create enjoyable public entertainment experiences. You agree not to engage in conduct that interferes with the experience, safety, integrity, or operation of a Brain Brew service or event.

Brain Brew, its hosts, or participating venues may refuse participation, remove a participant or team, withhold a prize, adjust a score, reject a team name, disqualify a participant or team, or restrict future participation for conduct including:

  • Cheating or attempted cheating;

  • Submitting false information or falsifying scores, eligibility, attendance, registrations, entries, or prize claims;

  • Harassment, threats, violence, unsafe behavior, abusive conduct, or excessive disruption;

  • Offensive, discriminatory, obscene, infringing, defamatory, misleading, or inappropriate team names or submitted content;

  • Interference with a host, venue, sponsor, other participants, scoring process, event operation, website, communication system, or promotional program;

  • Misuse of clues, answers, game materials, codes, reward programs, standings systems, or communications;

  • Violating venue rules or applicable law; or

  • Any conduct Brain Brew reasonably determines harms the event, venue, participants, business, brand, or integrity of its games.

6. Communications Consent and Preferences

Brain Brew may communicate with you through email, telephone, text message, MMS, voicemail, website chat, social media messaging, online forms, or other methods.

When you voluntarily submit contact information, Brain Brew may use it to respond to your inquiry, provide requested information, administer an event or program, manage an active business relationship, or communicate as otherwise permitted by law.

Where you separately opt in to promotional or recurring communications, Brain Brew may send marketing, promotional, entertainment, venue, sponsor, loyalty, tournament, game, clue, schedule, or event-related communications according to the consent you provided.

For recurring Brain Brew text message programs:

  • Message frequency varies;

  • You may receive up to approximately 8 to 10 recurring Brain Brew messages per month, plus messages you specifically request or initiate;

  • Message and data rates may apply;

  • Reply STOP to opt out of promotional text messages;

  • Reply HELP for help or email chris@brainbrewgames.com;

  • Consent is not a condition of purchase or participation in a free-to-play public game; and

  • Opting out of promotional messages does not prevent Brain Brew from responding to an inquiry you initiate or sending service-related communications where permitted by law.

Additional text messaging terms may be displayed at the time you opt in or on a separate SMS Terms page, and those additional terms are incorporated into these Terms.

7. Privacy

Your use of Brain Brew websites, services, events, forms, communications, and programs is subject to our Privacy Policy, which describes how we collect, use, disclose, and protect information.

By submitting information or using our services, you acknowledge that information may be processed as described in the Privacy Policy.

8. Photographs, Video, Public Events, and Submitted Content

Brain Brew events may occur in public-facing venues where photography, video recording, audio recording, social media posting, promotional activity, or public recognition of teams and winners may occur.

By attending a Brain Brew event, you understand that you may appear incidentally in photos, video, audio, crowd images, venue images, social posts, or promotional content captured in a public event environment.

If you voluntarily submit, post, tag, send, share, or authorize content involving Brain Brew, including photos, video, audio, testimonials, reviews, team names, comments, graphics, social posts, or promotional content, you grant Brain Brew a non-exclusive, worldwide, royalty-free, transferable, sublicensable license to use, reproduce, display, publish, distribute, adapt, edit, repost, and promote that content in connection with Brain Brew services, events, websites, advertising, marketing, social media, sponsor materials, venue promotions, and business operations.

You represent that you have the right to provide content you submit and that the content does not violate the rights of any person or entity.

You may request review or removal of content associated with you by emailing chris@brainbrewgames.com. Brain Brew will consider reasonable requests but cannot guarantee removal of content that has already been publicly distributed, shared by others, retained for legitimate purposes, or does not reasonably identify you.

9. Intellectual Property

Brain Brew websites, game concepts as expressed in Brain Brew materials, brand names, logos, graphics, designs, artwork, score sheets, answer slips, cards, question sets, clues, scripts, event formats, host materials, promotional materials, sponsor materials, text, photographs, video, audio, software, databases, standings presentations, website content, and other materials are owned by or licensed to Brain Brew and are protected by intellectual property and other applicable laws.

Except as expressly permitted by Brain Brew in writing, you may not:

  • Copy, reproduce, republish, distribute, sell, sublicense, display, modify, scrape, download, create derivative works from, or commercially exploit Brain Brew content;

  • Record, reproduce, distribute, or commercially use Brain Brew questions, answer sets, host scripts, game cards, score sheets, promotional materials, or other proprietary materials;

  • Use Brain Brew names, logos, marks, branding, graphics, or materials in a manner that suggests sponsorship, endorsement, partnership, ownership, or affiliation without written authorization;

  • Interfere with, reverse engineer, access improperly, or misuse our websites, forms, databases, communications systems, standings, CRM tools, or other technology; or

  • Use Brain Brew materials to operate, promote, or support a competing entertainment, trivia, bingo, game, or promotional service without written authorization.

Any permitted sharing of Brain Brew promotional materials must retain Brain Brew branding and may be revoked at any time.

10. Third-Party Venues, Sponsors, Links, and Services

Brain Brew services may involve, feature, or link to third-party venues, sponsors, advertisers, promotional partners, mapping tools, forms, chat tools, social media platforms, embedded content, ticketing or registration tools, prize providers, or other third-party services.

Brain Brew does not own or control third-party venues or third-party services unless expressly stated. Brain Brew is not responsible for third-party products, services, websites, privacy practices, content, advertisements, offers, food, drinks, alcohol service, premises, staff, policies, prizes, or conduct.

Your transactions, interactions, attendance, purchases, communications, or disputes with third parties are between you and the applicable third party.

11. Website and Service Availability

Brain Brew may modify, suspend, discontinue, restrict, or remove any website, feature, content, event listing, registration, standings page, communication program, game, promotion, or other service at any time without liability.

We do not guarantee that:

  • Websites or services will always be available, secure, complete, accurate, error-free, or uninterrupted;

  • Event schedules, standings, venue information, promotional offers, prize information, links, maps, or third-party content will always be current or accurate;

  • Communications will always be delivered or received;

  • Seats, reservations, venue access, prizes, event availability, or participation opportunities will remain available; or

  • Technical, scoring, administrative, communications, vendor, host, or venue errors will not occur.

12. Disclaimer of Warranties

TO THE FULLEST EXTENT PERMITTED BY LAW, BRAIN BREW WEBSITES, SERVICES, EVENTS, GAMES, PROMOTIONS, COMMUNICATIONS, CONTENT, STANDINGS, MATERIALS, AND PROGRAMS ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED.

TO THE FULLEST EXTENT PERMITTED BY LAW, BRAIN BREW DISCLAIMS ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, AVAILABILITY, SECURITY, QUIET ENJOYMENT, AND ANY WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE OF TRADE.

 
13. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, BRAIN BREW AND ITS OWNERS, OFFICERS, MEMBERS, EMPLOYEES, CONTRACTORS, HOSTS, AGENTS, AFFILIATES, SUBSIDIARIES, LICENSORS, VENUES, SPONSORS, PROMOTIONAL PARTNERS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST REVENUE, LOST DATA, LOST OPPORTUNITIES, LOSS OF GOODWILL, PERSONAL PROPERTY LOSS, EMOTIONAL DISTRESS, OR BUSINESS INTERRUPTION ARISING FROM OR RELATED TO YOUR USE OF OR PARTICIPATION IN BRAIN BREW SERVICES.

TO THE FULLEST EXTENT PERMITTED BY LAW, BRAIN BREW IS NOT RESPONSIBLE FOR CLAIMS OR LOSSES ARISING FROM OR RELATED TO:

  • Venue operations, food, beverages, alcohol consumption or service, premises conditions, seating, parking, security, staff conduct, or venue policies;

  • Personal injury, illness, accidents, property damage, lost property, theft, altercations, transportation, or conduct occurring at or relating to a third-party venue;

  • Cancellations, delays, weather, schedule changes, unavailable seating, host changes, venue closures, technical problems, communication failures, scoring mistakes, standings adjustments, incorrect listings, prize substitutions, or unavailable prizes;

  • Conduct of other participants, venues, sponsors, advertisers, promotional partners, service providers, or other third parties;

  • Third-party websites, applications, forms, ads, links, offers, maps, chat tools, social platforms, or privacy practices; or

  • Unauthorized access to or misuse of information despite reasonable safeguards.

TO THE FULLEST EXTENT PERMITTED BY LAW, BRAIN BREW’S TOTAL LIABILITY ARISING OUT OF OR RELATED TO ANY CLAIM WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID DIRECTLY TO BRAIN BREW FOR THE SPECIFIC SERVICE GIVING RISE TO THE CLAIM DURING THE SIX MONTHS PRECEDING THE CLAIM OR ONE HUNDRED DOLLARS ($100).

Some jurisdictions do not allow certain limitations of liability, so some limitations may not apply to you.

14. Indemnification

To the fullest extent permitted by law, you agree to defend, indemnify, and hold harmless Brain Brew and its owners, officers, members, employees, contractors, hosts, agents, affiliates, subsidiaries, licensors, venues, sponsors, promotional partners, and service providers from and against claims, damages, losses, liabilities, judgments, penalties, costs, and expenses, including reasonable attorneys’ fees, arising out of or related to:

  • Your violation of these Terms;

  • Your violation of applicable law or venue policies;

  • Your conduct at or relating to a Brain Brew event;

  • Content you submit, publish, transmit, tag, provide, or authorize;

  • Your misuse of Brain Brew websites, communications, services, games, materials, promotions, prizes, or intellectual property; or

  • Your infringement or violation of the rights of another person or entity.

 
15. Suspension and Termination

Brain Brew may suspend, restrict, or terminate your access to websites, games, events, promotions, communications, prizes, standings participation, loyalty benefits, or other services if we reasonably determine that you have violated these Terms, engaged in misconduct, interfered with our operations, created legal or reputational risk, or otherwise acted in a manner inconsistent with Brain Brew’s interests or the integrity of its services.

16. Governing Law and Disputes

These Terms and any dispute arising from or relating to Brain Brew websites, services, games, events, communications, promotions, or content will be governed by the laws of the State of Texas, without regard to conflict-of-law principles.

Unless applicable law requires otherwise, any legal action arising out of or relating to these Terms or Brain Brew services shall be brought in a state or federal court located in or serving Bexar County, Texas, and you consent to the personal jurisdiction and venue of those courts.

The parties are encouraged to attempt in good faith to resolve disputes informally before initiating formal legal proceedings by contacting info@brainbrewgames.com.

17. Changes to These Terms

We may revise these Terms from time to time. Revised Terms become effective when posted unless a later effective date is stated.

Your continued access to or use of Brain Brew websites or services after revised Terms are posted constitutes your acceptance of the revised Terms, subject to any additional consent required by law.

18. Severability and Waiver

If any provision of these Terms is found invalid, unlawful, or unenforceable, the remaining provisions will remain in full force and effect to the fullest extent permitted by law.

Brain Brew’s failure to enforce any provision of these Terms does not waive the right to enforce that provision or any other provision later.

19. Entire Agreement

These Terms, the Privacy Policy, any applicable SMS Terms and Conditions, and any separate official rules, agreements, registrations, proposals, invoices, releases, or event-specific terms accepted by you constitute the agreement between you and Brain Brew concerning the applicable services.

Where specific official rules or written agreements apply to a particular event, promotion, sponsorship, private booking, or service, those specific terms control to the extent of any direct conflict with these general Terms.
